Q: Will the Fat City Lofts Project destroy the historic preservation of Top's Night Club?
A: NO. We have reached an agreement with SOHO to preserve the façade of the historic Top's Night
Club and to incorporate it into our project. Please see the
attached SOHO letter supporting our project.
Q: How long has this property been zoned to include residential?
A: Since 1992. Under the 1992 PDO, the property is zoned Recreation/Visitor/Marine (RVM).
Multifamily Residential is a permitted land use under the RVM district. Under the 2006 PDO, the
property is zoned Mixed Commercial Land Use District (MC). Residential, live/work spaces, retail, and
artist studios are all allowable uses.
Q: Who supports the development of this project?
A: Local businesses and associations including JMI Realty, Pacifica Companies, A-1 Storage, the California Apartment Association, and the Building Industry Association are behind us. Please see the
attached
letters of support.
Q: Will the Fat City Lofts Project hurt Solar Turbine's ability to operate?
A: NO. None of Solar's 48 permits are affected by anything beyond their property line. We have
included a
legal opinion corroborating that our project will NOT constrain their existing permits or
require them to get any new permits.
Q: Does this project conflict with the General Plan's Economic Prosperity Element and Collocation?
A: NO. Unlike other areas like NASSCO, zoned Prime Industrial, Solar Turbines is located on Port
property and is zoned Aviation Related Industrial. The Solar Turbine site is NOT designated on the
General Plan Economic Prosperity Element's Industrial and Prime Industrial Land Map. Additionally,
our project is NOT being proposed within an Industrial Zone and our project does NOT require any
change in the underlying land use designation. Therefore, Collocation is NOT applicable in this case.

Q: Is the Project seeking any variance to the Community Plan or Planned Development Ordinance?
A: NO. The project does not seek any variance, and is consistent with the Community Plan, and the
1992 and 2006 Planned District Ordinance (PDO).
Q: What permit does this project need, which authority decides the permit, and what Process is
applicable for this project?
A: This project requires a Coastal Development permit, and is a Process 3 decision, to be decided by the
CCDC Board, and appealable to Planning Commission.
Q: Why should you support this project?
A: The Fat City property is zoned for mixed use, including residential uses. This zoning was the result
of several public processes, including the Community Plan Update and development of the 1992 and
2006 Centre City PDO. If you support a decision to deny the ability to develop an allowable use under
the existing rules today, at the behest of a neighboring property with no legal claim to the land, you will
set an extremely dangerous precedent that will have significant citywide implications on future
residential development.
